TERMS OF SERVICE.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (the user) and TWIMH Yazılım Teknolojileri Anonim Şirketi (referred to as "TWIMH","we", "our", or "us"), a joint-stock company organized under the laws of the Republic of Turkey.

By accessing our website, playing our games (web, mobile, or otherwise), or utilizing any of our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not download, install, play, or access our Services.

2. Eligibility & Age Restrictions

You must be at least 13 years of age (or 16 years of age in the European Economic Area) to use our Services. If you are between the minimum legal age and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Parents and legal guardians are responsible for the actions of their children while using our Services. If we learn that a user under the legal age has accessed our Services without appropriate guardian consent, we reserve the right to suspend or terminate access immediately.

3. In-Game Accounts

Certain Services may enable you to create a guest account or link accounts (such as your Apple Game Center, Google Play Games, or Facebook accounts). You are solely responsible for keeping your login credentials confidential and securing your account.

You agree that you will not sell, trade, rent, or transfer your account under any circumstances. TWIMH reserves the right to deactivate, terminate, or suspend any account that violates these Terms or remains inactive for a prolonged period.

4. License to Services

Subject to your compliance with these Terms, TWIMH grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and play our games, browse our site, and use the Services for your personal, non-commercial entertainment purposes.

This license does not grant you any ownership rights in the Services. You agree not to copy, modify, distribute, publicly perform, reverse engineer, decompile, translate, or exploit the Services, in whole or in part, without our prior express written consent.

5. Virtual Items & Purchases

Our games may include virtual, in-game assets, currencies (e.g., coins, diamonds, stars), or items (collectively referred to as "Virtual Items"). These Virtual Items can be earned through gameplay or purchased using real-world currency through app stores (Apple App Store, Google Play Store).

6. User-Generated Content (UGC)

Our Services may allow you to submit feedback, user names, profiles, chat messages, or images (collectively,"User-Generated Content" or "UGC"). You retain ownership of your UGC.

However, by submitting UGC, you grant TWIMH a worldwide, royalty-free, perpetual, irrevocable, fully transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute your UGC in connection with operating and marketing the Services. You represent that you have all rights to grant this license and that your UGC does not infringe any third-party rights.

7. User Code of Conduct

You agree to use our Services in a lawful and respectful manner. You must not:

• Use cheats, exploits, bots, hacks, mods, or any unauthorized software to interfere with game mechanics.
• Harass, abuse, threaten, or defame other players or TWIMH staff members.
• Reverse engineer, disassemble, or attempt to extract source code from the Services.
• Use the Services for commercial advertisement or promotion.
• Circumvent any security filters, IP bans, or geofences placed by TWIMH.

We reserve the right to suspend, terminate, or ban your access to our games if we detect any violations of these rules.

8. Intellectual Property Rights

All materials, assets, and content forming part of our Services—including but not limited to game code, software, algorithms, graphics, visual designs, audio clips, sound effects, music, characters, character designs, dialogues, names, logos, and trade marks—are the exclusive property of TWIMH Yazılım Teknolojileri Anonim Şirketi or its licensors.

TWIMH is protected by Turkish copyright laws, international treaties, and applicable trademark and intellectual property legislation. Unauthorized copying, redistribution, or modification of these materials is strictly prohibited and may trigger civil and criminal penalties.

9. Disclaimers & Warranties

THE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TWIMH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TWIMH YAZILIM TEKNOLOJILERI A.Ş. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS OR FROM THE USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TWIMH IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by, interpreted, and construed in accordance with the laws of the Republic of Turkey.

You agree that any legal dispute, action, or litigation arising out of or relating to our Services shall be submitted exclusively to the jurisdiction of the Elazığ Courts and Execution Offices.

12. Severability & Entire Agreement

Severability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement: These Terms, including the Privacy Policy, constitute the entire agreement between you and TWIMH regarding the Services, superseding any prior or contemporaneous written or oral agreements or communications.

13. Amendments & Contact Information

We reserve the right to amend, modify, or update these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued play of our games or use of our Services following any modifications constitutes your acceptance of the new Terms.
